If you are a living individual residing in the United States and you received notice from DRS Roberts & Bryan PA d/b/a Brevard Skin & Cancer Center (“BSCC”) that your Private Information may have been impacted during the targeted cyberattack on BSCC's computer systems that occurred in September 2025, then you may be a Settlement Class Member and eligible for benefits. Excluded from the Settlement Class are: (a) all persons who are directors, officers, and agents of Defendant; (b) governmental entities; (c) the Judge assigned to the Action, that Judge’s immediate family, and Court staff; and (d) any Settlement Class Member who timely opt outs of the Settlement.

If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by November 16, 2026.

BSCC has agreed to pay for a number of Class benefits, which are explained below. All Class Members are eligible to claim one year of Medical Data Monitoring from CyEx Medical Shield Complete, and one of two Cash Payment options.

Medical Data Monitoring. All Class Members are eligible to enroll in one (1) year of CyEx Medical Shield Complete. Enrollment codes have been sent to all Class Members by postcard. If you no longer have your enrollment code, please contact the Settlement Administrator. This comprehensive service comes with $1 million of medical identity theft insurance, and includes monitoring for:

  • healthcare insurance ID exposure

  • Medical Record Number (MRN) exposure

  • unauthorized Health Savings Account (HSA) spending

If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Cash Payment A - Documented Losses. Class Members who incurred actual, documented out-of-pocket losses due to the Data Incident, can get back up to $2,500.00. The losses must have occurred between September 28, 2025, and November 16, 2026. This benefit covers out-of-pocket expenses like:

  • losses because of identity theft or fraud

  • fees for credit reports, credit monitoring, or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

You need to submit proof, like bank statements or receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Cash Payment B - Alternate Cash. Instead of a payment for Documented Losses, you may claim a one-time $45.00 cash payment.

The deadline to submit a Claim Form online or by email is November 16, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than November 16, 2026.
